The Hidden Dangers of Using AI for Estate Planning in New Jersey

Why Cutting Corners with Artificial Intelligence Could Cost You Everything

In a world where you can order a pizza, diagnose a rash, and write a wedding toast with artificial intelligence—all in under five minutes—it’s no wonder some people are turning to AI for estate planning. After all, who wouldn’t want to save time and money?

But here’s the hard truth: AI might be great for dinner reservations or drafting emails, but when it comes to something as serious, nuanced, and legally binding as your estate plan—especially in a state like New Jersey—it could do more harm than good.

What’s the Problem?

Let’s break it down.

1. New Jersey Law Is… Complicated

The Garden State doesn’t mess around when it comes to estate and inheritance laws. We’ve got our own rules on inheritance tax, elective shares, guardianship, Medicaid eligibility, and probate proceedings. AI platforms—especially generic ones—aren’t built to catch these hyper-local nuances.

One wrong clause in a DIY will? Your assets could end up going outright to the wrong people or be tied up in litigation for years, costing your loved ones thousands.

2. AI Doesn’t Know Your Family Drama

Have a son-in-law you don’t trust? A grandchild with special needs? A sibling who’s been sniffing around your finances? AI can’t sense red flags.

An experienced estate planning attorney doesn’t just “draft documents”—they strategize, taking family dynamics, personality clashes, and long-term protection into account.

AI is only as good as the questions you ask. An experienced attorney knows what to ask. Do you?

AI, by contrast, assumes your family is the Brady Bunch.
Spoiler alert: they’re not.

3. Cookie-Cutter = Courtroom Disaster

AI-generated documents are often one-size-fits-all. But estate planning is not one-size-fits-anything. New Jersey probate judges see plenty of cases where vague language or conflicting documents land families in court.

Oftentimes, when we review AI-generated documents, clients realize their ideas don’t look the same on paper. That realization only happens because an attorney makes suggestions and asks nuanced questions.

The result of skipping that process? Delays. Confusion. Legal fees. And, worst of all, broken relationships.

4. No Guidance = Big Mistakes

Estate planning isn’t just about writing a will. It’s about:

  • Choosing the right type of trust
  • Understanding Medicaid lookback periods
  • Appointing guardians for minor children
  • Planning for long-term care
  • Navigating NJ-specific tax pitfalls

AI tools don’t ask the right follow-up questions. Attorneys do.

Most clients arrive at a meeting with a perceived problem. They leave the consultation realizing that either the solution to that problem creates new unintended risks—or that they have greater problems they didn’t consider at all.

How can AI compete with that level of insight?

5. AI Can’t Advocate for You

When things go sideways—and they often do—who’s standing in your corner? Not the chatbot.

A licensed elder law attorney in New Jersey can represent you, speak with courts, help your family after your passing, and ensure your plan evolves with your life.

AI can barely pronounce testamentary capacity, let alone defend it in court.

Bottom Line: AI Can Assist, But It Can’t Replace

We’re not anti-technology. At NJ Elder Law Center, we actually use AI and automation behind the scenes—to help streamline our processes and deliver faster service to our clients.

But when it comes to making decisions about your future, your assets, and your legacy? That should still involve a qualified human being who knows New Jersey law inside and out.
